Overview

Pixqon is a small one person 3D studio. The terms “I”, “me”, “we”, “us” and “our” refer to Pixqon. This site and store, including all related information, content, features, tools, products and services, are called the “Services”. The store is powered by Shopify, which helps me run everything behind the scenes.

These Terms of Service (the “Terms”) describe what you can expect from me, what I expect from you and how things work when you use the Services or buy any Pixqon products.

By visiting, interacting with or using the Services, you agree to be bound by these Terms and by the Pixqon Privacy Policy on this site. If you do not agree, you should not use the Services or place an order.

1. Access and account

By using the Services, you confirm that you are old enough to enter into a binding agreement where you live. If you allow a minor to use the Services on a device you manage, you are responsible for their use, where this is allowed by local law.

To browse the store or place an order you may be asked for details like your email address, billing information and shipping address. You promise that any information you provide is correct and that you will keep it up to date.

If you create a customer account you are responsible for keeping your login safe and for everything that happens under that account. You must not sell or transfer your account. If you think your account has been compromised, please let me know as soon as you can.

2. Pixqon products

Pixqon offers physical 3D printed products and digital products such as STL files for 3D printing. I try to show these as clearly as possible with photos, renders and descriptions. Colors and details can still look different on your own screen depending on your device and settings.

I cannot promise that every product will look exactly like what you have in mind or print perfectly in your specific setup. Printed results depend a lot on your printer, materials and slicer settings, which I cannot control.

Product descriptions, availability and pricing can change at any time without notice. I may limit or discontinue products for any person or region on a case by case basis.

3. Orders

When you place an order you are making an offer to buy. I reserve the right to accept or decline any order at my discretion, for example if the product is unavailable, there is a clear error in pricing or description, or payment cannot be processed.

Your order is accepted when your payment is successfully processed and you receive an order confirmation email. Until then I am not required to supply any products in your cart.

Please check your order carefully before submitting. After an order is accepted it may not be possible to cancel or change it. Returns and refunds, if available, are handled under the Refund policy on this site and any rights you have under local law.

4. Prices and billing

The price you see at checkout is the price that applies at that moment. Prices, discounts and promotions can change over time. Changes do not affect orders that have already been accepted.

For physical products, the product price usually includes standard shipping to the countries and regions offered in the store, unless I clearly state otherwise at checkout. Any customs, import fees or local taxes that are not collected at checkout are your responsibility if they apply in your country.

Digital products such as STL files do not require shipping and are made available for download after successful payment. Prices in this store may be different from prices in any other channels or stores.

You agree to provide current and accurate payment details and to update them if needed so your orders can go through. By submitting a payment method you confirm that you are allowed to use it and that you will pay all charges incurred for your orders, including any applicable taxes and fees.

5. Shipping and delivery

Physical products are shipped only to the countries and regions that appear as options at checkout. If your country is not shown, I currently do not ship there from this store. Digital STL files are accessible worldwide unless restricted by law or by specific product notes.

Any delivery times shown are estimates, not guarantees. I am not liable for delays caused by carriers, customs or events outside my control. Once an order is handed over to the carrier, risk of loss passes to you, as allowed by local law.

6. Digital products and STL license

When you buy a digital product such as an STL file you are not buying the intellectual property itself. You are buying a license to use that file.

• You receive a personal, non exclusive, non transferable license to download and use the file to print items for yourself or as gifts, subject to any specific notes on the product page.
• Unless I agree in writing, you may not resell, share, upload, distribute or sublicense the digital files themselves, and you may not use them for mass production or commercial manufacturing.
• You are responsible for checking that your printer, materials and settings are safe and suitable. Printed parts should not be used where failure could lead to injury, damage or safety issues.

7. Payments

Payments are processed securely through Shopify and its payment providers. I do not store your full card number. If a charge looks wrong, please contact me first so I can help investigate with the payment provider. If payment does not go through, I am not required to fulfill the order.

8. Returns, refunds and downloads

Returns, exchanges and refunds for physical products are governed by the Pixqon Refund policy shown on this site, together with any mandatory rights you have under local law.

Because digital products are available to download immediately after purchase, refunds for digital products are usually not offered except where required by law. If a file is corrupted or you are having trouble accessing a download, email me and I will do my best to help you get a working copy.

9. Intellectual property

All Pixqon designs, models, images, graphics, logos, text, and other content on the Services are owned by or licensed to Pixqon and are protected by copyright, trademark and other laws. Except for the limited license described in section 6, you do not get any ownership rights in that content. All rights not expressly granted are reserved.

10. Feedback, reviews and photos

If you share reviews, photos, ideas or other feedback about Pixqon, you confirm that you have the right to share it and that it does not violate anyone else’s rights. You give Pixqon a worldwide, non exclusive, royalty free license to use that content to operate and promote the store, as allowed by law. You can always email me if you would like me to stop using your content in future materials.

11. Optional tools and third party links

The Services may give you access to tools, apps or content from third parties, such as payment providers, analytics, or social media. These are provided “as is” and “as available”, and I do not control them. Your use of any third party service is at your own risk and you should review their terms and privacy policies.

I am not responsible for any harm or loss you may suffer from using third party sites, tools or products that are linked from this store.

12. Relationship with Shopify

This store is powered by Shopify. Shopify provides the ecommerce platform, but any sales and purchases you make are between you and Pixqon, not between you and Shopify. By using the Services you understand that Shopify is not responsible for Pixqon products or for any issues that come from your purchases here. You agree that your claims about orders or products are directed to Pixqon, and you release Shopify and its affiliates from claims and damages related to those purchases, as allowed by law.

13. Privacy and personal information

How your personal information is collected and used is described in the Pixqon Privacy Policy available on this site, and in Shopify’s own privacy policy. By using the Services you agree that your personal information will be handled according to those policies.

14. Errors, inaccuracies and omissions

Sometimes there may be information in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. I reserve the right to correct these and to change or update information or cancel orders if any information is inaccurate at any time, including after you submit an order, where the law allows it.

15. Prohibited uses

You agree not to use the Services to:

• break any laws or regulations;
• infringe the rights of Pixqon, Shopify or any third party;
• harass, abuse, threaten or harm anyone;
• send spam or other unwanted promotional messages;
• upload or spread viruses or other malicious code;
• scrape or crawl the site in a way that could damage performance;
• try to bypass or interfere with security features of the Services.

If you misuse the Services or break these Terms, I may suspend or close your access without prior notice, as allowed by law.

16. Termination

I can suspend or terminate your access to the Services at any time if I reasonably believe you have broken these Terms or misused the Services. You can stop using the Services at any time. Even after termination, sections that are meant to continue, such as intellectual property, license terms, warranty disclaimers, limitations of liability and dispute sections, will still apply.

17. Disclaimer of warranties

Except where I clearly say otherwise and to the fullest extent allowed by law, the Services and all products are provided “as is” and “as available”. That means I do not give guarantees about things like uninterrupted access, specific results, or that every print will work with your specific setup. Any use of the Services or products is at your own risk, except where local law gives you rights that cannot be limited.

18. Limitation of liability

To the fullest extent permitted by law, Pixqon, its partners and service providers, and Shopify and its affiliates, are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Services or products, even if they have been advised that such damages are possible. Where the law does not allow this exclusion, liability will be limited to the amount you paid for the product or service that gave rise to the claim, or to the minimum greater amount required by that law.

19. Indemnification

As far as the law allows, you agree to indemnify and hold harmless Pixqon, Shopify and their respective affiliates, employees and service providers from claims, losses, damages and costs, including reasonable legal fees, that arise from your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Services or products.

20. Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the maximum extent allowed and the rest of the Terms will remain in full force.

21. Waiver and entire agreement

If I do not enforce a right or provision of these Terms, that does not mean I give up that right for the future. These Terms, together with any policies posted on this site, are the entire agreement between you and Pixqon about the Services and replace any earlier agreements about the Services.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without my written consent. I may assign or transfer my rights and obligations under these Terms without needing your consent, as long as this is allowed by law.

23. Governing law and disputes

To the extent the law allows, these Terms and any disputes related to them or to the Services will be governed by the laws that apply where Pixqon is established, without regard to rules about conflicts of laws. If those laws cannot apply, then the laws of your place of residence will apply. You agree to first contact me to try to resolve any dispute informally. Nothing here removes any rights you may have to bring a complaint to a consumer protection or data protection authority in your region.

24. Changes to these Terms and contact

I may update these Terms from time to time. When I do, I will adjust the “Last updated” date at the top of this page. In some cases I may also provide extra notice, for example on the site or by email. If you keep using the Services after changes take effect, you are agreeing to the updated Terms.
